TERMS AND CONDITIONS

By booking accommodation with Apad Properties Limited, you are deemed to have read in full and accepted the following Terms and Conditions:

1.CONTRACT

1.1 Your booking is with ApadProperties Limited (referred to as APAD in these terms and conditions), which is a Limited Company registered in England and Wales Company Number 9013563
.References to “you” or “your” are references to the person or organisation making the booking with APAD.
1.2 Your booking is confirmed as a legal contract once your payment has been successfully made. No booking is made or contract agreed when payment is declined or unauthorised.
1.3 All warranties, conditions and other terms implied by statute or common Law or otherwise are, to the fullest extent permitted by law, excluded from any contract with us and these conditions shall apply in their place.

2.BOOKING CONDITIONS

2.1 Age. Bookings may only be made by a person aged 25 or above and there must be at least one person aged 25 or above staying in the accommodation.
2.2 Proof of ID. Proof of identity is required before entry to the booked accommodation will be granted. This ID must match the owner of the payment card used.
2.3 Security deposit. You will be required to pay a security deposit before entry to the booked accommodation will be granted. Such security deposit shall be fully refunded after check out, subject to clause 4 below.
2.4 Occupancy. Under no circumstances may more than the maximum number of persons specified in the booking occupy the property, all of whom shall comply with the conditions and restrictions in this agreement.

3. USAGE OF THE PROPERTY

3.1 Security of tenure. You agree that the booking is for a short term stay for leisure, business or temporary purposes and does not give rise to an assured shorthold tenancy or lease. No rights of tenancy are conferred and the contract is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977.
3.2 Assignment and sublease.You may not re-sell or re-assign or sublease the property or permit the use of any portion of the property by other persons or organisations who are not included within the number of and as permitted occupants under this Agreement.
3.3 Rights of Access. Representatives of APAD or their subcontractors have the right of access to the property at any time, with due regard to the convenience of the hirer, for the purpose of inspection of the property and to carry out any essential repair or maintenance work, or for viewings organized by rental agents.
3.4 Unavailability of the Property. 
In the event the Property is unavailable for use during the Booking Term due to reasons, events or circumstances beyond the control of APAD, APAD will apply due diligence and good faith efforts to locate a replacement property. If such replacement property cannot be found, APAD shall return all payments made by you, whereupon this Agreement shall be terminated and APAD shall have no further obligations or liabilities in any manner pertaining to this Agreement.

4. ADDITIONAL CHARGES

APAD reserves the right to retain the security deposit (or part thereof) and additionally to charge to the payment card used for the booking for breaches of terms and conditions. Where APAD is unable for any reason to apply such a charge against your payment card, then an invoice will be sent to you, which you agree to pay within 14 days of receipt.Interest on overdue invoices shall accrue from the date when payment becomes due, accrued daily, until the date of payment, at a rate of 4% above NatWest Bank base rate in force at the time and shall accrue at such a rate after, as well as before any judgement.

4.1 Lost, damaged or non returned keys. Front door/back door/patio or padlock will be charged at £25 each. In addition, we reserve the right to charge for lock replacement, as in the interests of security, we may have to replace the corresponding locks.
4.2 Breach of our non-smoking policy. A standard charge of £200 will levied where we find evidence of smoking within the accommodation to cover cleaning costs, but we reserve the right to charge additional amounts to cover any further damage caused by smoking.
4.3 Damage/Loss. We reserve the right to charge for the cost of replacing or repairing any items damaged during your stay or missing post check-out, including but not limited to furniture, upholstery, appliances or any other fixtures and fittings.
4.4 Unauthorised stays. We reserve the right to charge for an additional night’s stay for every day the keys are not returned at our full, non-discounted rate. In the event of a refusal to vacate the Property by the booked check-out date and time, we reserve the right to remove all persons and personal belongings from the Property. Any items left in an apartment past the agreed departure time, are left at the owners risk – we accept no responsibility for these items and reserve the right to remove and store them.

5. LIABILITY

5.1 Personal belongings. You agree that all personal property, personal affects and other items brought into the Property by you or your visitors shall be at your sole risk with regard to any theft, damage, destruction or other loss and that APAD shall not be responsible or liable for any reason whatsoever.
5.2 Services. The Property is provided in “as is” condition. APAD shall use its best efforts to ensure the operation of all amenities in the Property, such as wi-fi, internet access, TV, heating and hot water. APAD shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
5.3 Force Majeure. We regret that we cannot accept liability for any loss, damage or additional expense where the booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events of ‘force majeure’. Force majeure means any event which could not have been reasonably foreseen, or the consequences could not have been reasonably avoided. Such events may include war or threat of war, civil strife, terrorist activity, industrial dispute, natural or man-made disaster, fire, epidemic or pandemic, adverse weather conditions and all similar events outside our or the relevant suppliers’ control.
5.4 Limit of liability. You hereby covenant and agree to indemnify and hold harmless APAD and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, legal fees incurred by you, your visitors or agents, representatives or your successors due to any claims relating to destruction of property, or injury to persons, or loss of life sustained in,on, or near to the Property, including any common facilities, activities or amenities. You expressly agree to save and hold APAD harmless in all such cases.
5.5 Consequential or indirect loss. APAD shall not be liable in any circumstances to you for any consequential or indirect loss including loss of profit, data, management time, reputation or goodwill.

6. DATA & PRIVACY

6.2 Accuracy. All information supplied by APAD about the Properties available for short term accommodation is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made either in writing or otherwise, but APAD is not liable for any variation however caused.

7. DEFAULT

Should you fail or we reasonably suspect that you have failed to comply with the terms and conditions of this Agreement, you shall surrender the Property, remove all personal belongings and leave the Property in good order and free of damage if so instructed. No refund of any kind shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

8. LAW AND JURISDICTION

These conditions and terms of contract and all matters arising therefrom are subject to the Law of England and Wales and in the event of dispute; the client will be subject to the exclusive jurisdiction of the courts of England and Wales.
